The Congress on Bankruptcy and Company Law will analyze the recent Draft Bill to reform the consolidated text of the Bankruptcy Law.

The next 23 and 24 September will be held in Benicàssim the III Congress of Bankruptcy and Company Law. On this occasion, commercial magistrates and professionals in law and economics will have the opportunity to analyze the recent Draft Law to reform the consolidated text of the Bankruptcy Law. The text has caused enormous concern among the affected sectors, since it provides for a new “special” bankruptcy procedure for small companies, which would be processed without the intervention of a lawyer, solicitor or bankruptcy administration. Also striking is the overprotection of public credit that is observed in the Draft Bill, which could turn the restructuring plans and the exoneration of unsatisfied liabilities for debtors into a chimera, which are the objectives pursued by directive (EU) 1023/2019 which intends to incorporate the draft law.

It is logical, therefore, that there is a lot of interest in discussing this Draft Bill and trying to reach conclusions that can later be enforced in the parliamentary process of the same.

The Castellón College of Economists, the Provincial Tourism Board and Trademat Europe sponsor this congress, which has the collaboration of the General Council of Economists and the Benicàssim City Council, a town that has hosted the forum since the first edition.

The Fundación Universitat Jaume I-Empresa is in charge of organizing the congress, which plans to address very topical issues, such as ways to speed up the sale of production units inside and outside the competition (“prepack”), along with other topics " classics ”, but which continue to retain much practical interest, such as how to effectively settle (and in a reasonable time) insolvency proceedings or the problems generated by loans against the estate in a scenario of" limited mass ", such as, by definition, bankruptcy.

As in previous editions, the insolvency of natural persons and the benefit of the second chance, or the labor aspects within the bankruptcy, will also be present in the debate, considering that they continue to generate interest and many questions.

Along with a panel of experts on the latest developments in corporate law, a table is also reserved to discuss, from a prospective perspective, the reforms currently underway and, from a desiderative perspective, the reforms that bankruptcy law should undertake in the near future.

Legal experts and Magistrates Judges of Commercial Courts from various parts of Spain will participate as speakers.
