"Debt restructuring and other questions raised by the reform of the Consolidated Text of the Bankruptcy Law"

On June 2 and 3, 2022, the IV Congress of Bankruptcy Law: "Debt restructuring and other questions raised by the reform of the consolidated text of the Bankruptcy Law" will take place in Benicasim.

The necessary incorporation of Directive 2019/1023, on preventive restructuring frameworks, has led to a process of profound reform of the consolidated text of the Bankruptcy Law, which raises many questions.

On the one hand, it is true that it opens up new professional opportunities in the field of "pre-bankruptcy", by introducing the figure of the expert in debt restructuring, who precisely seeks to avoid having to go to bankruptcy. The directive makes this debt restructuring one of its pillars, with Congress focusing on the figure of the expert, his duties and the appointment system.

But along with that, the TRLC reform project, currently in the parliamentary process, generates a good number of doubts, linked to the future of the profession of insolvency administrator. The congress aspires to answer these questions, in order to be able to offer a certain tranquility to the professionals who are dedicated to it, also addressing several of the practical incidents that most affect them, such as the actions of demand of responsibility or the files referral by public bodies.

Another of the mainstays of the directive is the full debt relief of the individual debtor. Although it is a tool already regulated in Spanish law, there are so many innovations that the bill introduces in this field that it has been considered necessary to continue delving into it.

In short, the congress did not want to stop touching on other matters, which, not being directly affected by the directive, have been amended by the bill, or continue to generate debate in practice. Among the first are the special procedure in Book Three, or changes in the liquidation of assets and the role that specialized entities may play in the future; among the latter, it is worth mentioning the most common registration issues when undertaking the sale of insolvent real estate.

All this will be discussed at this meeting of professionals, which, for the fourth consecutive edition, will be held in the town of Benicàssim.
